Powers

Read through the Constitution on page 760 of your text. While you read pick one expressed power of the 27 listed and blog about that power. Like the Amendment blog, try not to repeat the previous blogs. I also would like an example of how the power is used and by whom it is used (National or State gov't.)

The tenth amendment is a good example of the limited powers. It states that if something is not expressed in the Constitution then it cannot be used. This is where the National government has its limited power. They cannot do anything that is not expressed in the constitution. So the National government loses it's power in that situation since it cannot really do anything about it and it cannot control it.

The Vice President has the power to be the PResident of the Senate but doesn't have a vote, unless they are equally divided. This is a power of the Senate.

"The right of Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebeliion or Invasion the public safety may require it." Habeas Corpus is theprotection for an individual from unlawful dentenion. Only the Federal Government can suspend the right of Habeas Corpus. This however can only be done in times of emergency. This part of the Consitution is not only an expressed power but also a check of power. The only time Habeas Corpus was suspended was in the Civil War by Abraham Lincoln.

The federal government has the power to declare war. It states so in the Constitution. This makes it an expressed power. The state govenments can not do it, so it is a power of the national government.

One expressed power is the right to collect taxes. This is an expressed power that the national government has a right to do. An example would be like when people pay their income taxes.

Congress has the right to borrow money on credit of the United States. This is an expressed power in the constitution. It is one given to the national government. It is used often now days, especially during out rime at war.

The ability to coin money is an example. No state can generate there own money, that would mess with the inflation. Coin money is a Naitonal Power.

An expressed power is that the Senate shall have the power to try all impeachments. When the president of the US is tried, the Chief Justics shall preside. This gives much more power to the Senate. They are the first to constitute if it is a legal impeachment or not.

No person shall be a senator who shall not have attained to the age of thirty years, and been nine years a citizen of the United States, and who shall not, when elected, be an inhabitant of that state for which he shall be chosen. This power is exercised by the senate that basically says that the senator has to be at least 30, a citizen in the state, and citizen for 9 years. This power is used to make sure that the senator is matured and also not running from another state to control there power in the senate.

artical 1 Section 8 gives power to the congris to borrow money on the credit of the united states. this is national power.

Article 3 section 3 states that congress has the power to call treason. This is an expressed power.

It is an exressed power that exectutive powers are vested in the President of the United States. He shall hold his office for a term of 4 years.

The right to provide and maintain a navy. It is pretty eslf explanatory. It is a national power and the state has no involvemtn in the navy.

To make rules for the Government and Regulation of the land and naval forces. This grants them to allow laws about the military on land and sea. This is done by the national government alone.

THe government is able to declare war and also many other different things. They are the ones who can amke different laws for the country and also the states. They can also declare what kind of tax will be taxed on each state and able to collect it

Article IV-Section 1.
Full Faith and credit shall be given in each State to the public Acts, Records, and judicial Proceedings of every other State. And the Congress may by general Laws prescribe the Manner in whihc such Acts, Records and Proceedings shall be proved, and the Effect thereof.

Full Faith and Credit shall be given in each State to the public Acts, Records, and judicial Proceedings of every other State. Same-sex marriage is one part of the Full Faith and Credit Clause.

In the constitution, it says that the federal government has the power to declare war. Because it is stated in the constitution, it is an expressed power. States cannot declare war.
